It’s look less and less likely that Brendan Sorsby will be suing the NFL

It’s been two days since the NFL told quarterback Brendan Sorsby that it won’t be conducting a supplemental draft next month. Despite his lawyer, Jeffrey Kessler, issuing a bellicose statement suggesting that a legal challenge is coming, nothing has happened.

With each passing hour, it’s becoming less and less likely that anything will.

If Sorsby sues, he’ll seek prompt relief aimed at forcing the NFL to conduct a supplemental draft next month. Kessler will want to move quickly, in order to get a date in place for a supplemental draft and to allow interested teams to properly scrutinize him.

If Kessler will be asking a judge to move quickly, Kessler needs to move quickly, too.

Beyond the practical realities of waiting to file paperwork and to schedule a hearing for a temporary restraining order and/or a preliminary injunction, a judge could react to a supposedly urgent request to conduct a hearing ASAFP by asking a simple question — what took you so long to initiate the process?

The paperwork could have been filed by Wednesday. If it’s not filed by the close of business on Friday, our guess is that it won’t be.

Which could be the best outcome for Sorsby. The league office doesn’t want him in the NFL this year. If he sues and win, the NFL may hold a grudge. (It wouldn’t be the first time.)

Many in the court of public opinion want a pound of flesh. If Sorsby doesn’t play in 2026, they will have gotten it.

Regardless, if he’s going to sue, it’s getting late. The clock is ticking. As soon as tomorrow, it could be too late.

Frankly, it already may be.
